RULES

This regulation defines the rules for making purchases in the online store

carried out by the Seller at https://sushiicons.pl/

The seller is SUSHI ICONS SP. Z O.O. with its head office in Warsaw, on Chrystian Piotr Aigner Street 6/U5, 00-710, NIP 521391481, REGON 389164645,

§ 1 Terms

1. Rules – this Regulation. In electronically certified services the Rules are the regulation referred to in Article 8 of the Law of 18 July 2002 on the Rules for Providing Services by Electronic Means (Dz.U.z2002r.Nr144,poz.1204zezm.).

2. Customer – an individual, legal entity, or organizational unit that does not have the status of a legal entity, but has the capacity to make transactions, and which, in accordance with the rules established by these regulations, places Orders in the online store

3. Consumer – a customer, a physical entity who uses the Online Store for a purpose not directly related to their economic or professional activities.

4. Service Provider – an economic entity that provides sales services through the Online Store in accordance with the conditions specified in these Rules.

5. Subject of the transaction – Goods listed and described on the website of the online store.

6. Goods – a movable item demonstrated in the Online Store to which the Sale and Purchase Agreement applies.

7. Sale and Purchase Agreement is an agreement for the sale and purchase of goods within the meaning of the Civil Code, concluded between the Service Provider and the Customer, using the online service of the Store. 

8. Online Store (Shop) – the website available at https://sushiicons.pl, through which the Customer can place an Order.

9. Order – a statement of the will of the Customer, which clearly defines the type and quantity of goods, aimed directly at concluding the Sale and Purchase Agreement. 

10. Telecommunication systems – a complex of interconnected computer devices and software that provides processing, storage, as well as sending and receiving data through telecommunication networks using an end device appropriate for a given Type of network.

11. Payment system operator – an organization that provides online payment services FONDY LTD, 40 Gracechurch Street, London EC3V 0BT, England. Fondy Ltd

12. BONUSES — notional incentive units which are awarded to the User within the framework of loyalty programs and/or referral programs conducted by the Operator or Partners, and which can be used by the User only in the manner and under the conditions specified in this Public Offer and/or the Rules of the respective program.

13. REFERRAL PROGRAM — a marketing program of the Operator, according to which the User can receive Bonuses for inviting other persons to use the Platform on the terms specified by the Operator and published on the respective web pages.


§ 2 General provisions

1. These Rules determine the terms of use of the online store at www.sushiicons.pl. The terms of placing the Order in the Online Store by the Customer are being familiarized with these Rules and accepting their provisions when placing the Order.

2. The Sushi Icon online store carries out retail sales through the Internet.

3. Within the technical conditions necessary for cooperation with the telecommunication system used by the Service Provider in order to implement orders, the Client must have an active e-mail account and an Internet-connected device that meets the following minimum technical requirements:

1. Internet browser Internet explorer version 10 or later.

2. The minimum screen resolution is 1024×768 pixels.

3. The Client is obliged not to provide content prohibited by law, such as content that promotes violence, disrespect, or violation of personal rights and other rights of third parties.


§3 Checkout

1. All prices posted on the Sushi Icons website are gross prices in Polish zlotys. Prices shown do not include delivery costs.

2. Orders are accepted through the website.

3. Orders placed through the site can be placed from Sunday to Thursday from 12:00 to 22:00, from Friday to Saturday from 12:00 to 23:00 (on holidays, opening hours may be changed).

4. The order shall take effect if the Customer correctly fills in the order form and correctly specifies the contact details, including the exact address to which the order is to be sent, as well as the phone number and email address.

5. In case the specified data is incomplete, the Seller will contact the Customer.

If it is not possible to reach the Customer, the Seller has the right to cancel the Order.

6. During the order process, the customer may express a desire to receive a VAT check or invoice, which can be added to the order being delivered or sent by mail to the specified address.

7. In the process of placing an Order, the Customer may give their consent to place and process their personal data in the Seller's online store database while fulfilling the Order. If consent is given, the Client has the right to review their data, correct it, and request it to be deleted.

8. After successful checkout, the Customer will receive an automatic response from the store confirming the checkout.

9. The start time of order processing coincides with the moment of transferring the payment to the bank account connected to the payment system in case of payment by bank transfer or with the moment of placing the order in case of payment by card.

10. Sale of alcohol. Confirmation of the Order by the Customer is equivalent to making a statement that the Customer is not a person who, in accordance with Article 15 of the Law on Sobriety Upbringing and Counteracting Alcoholism, is prohibited to buy alcoholic beverages, and does not buy alcohol for subsequent resale.

In case of doubt about the legal age of the Customer, the Seller may contact the Customer via the Customer's phone or email address stored in the Account and ask the Customer to present an ID with a photo and date of birth, as well as agree with the Customer on how the Customer will present an ID, otherwise the purchase being at risk of denial by the Seller.


§4 Delivery cost

1. The order is delivered to the address specified in the order form. The restaurant will immediately notify the Customer of an incorrectly completed order form that prevents or may delay the delivery.

You can pick up your order in person at the Sushi Icons Sushi Bar.


§5 PAYMENTS

  1. We issue a VAT receipt or invoice for each order sold.
  2. Payment for the order can be made upon picking up the goods in the store personally in cash or through the electronic payment system FONDY LTD, 40 Gracechurch Street, London EC3V 0BT England, when ordering via the Internet page.

§6 LOYALTY AND REFERRAL PROGRAMS  


1. The Operator has the right to implement and conduct loyalty programs, including a referral program (hereinafter referred to as the "Programs"), for the Platform Users. Participation of the User in such programs is voluntary and is carried out by performing the actions provided for by the relevant rules of the program.


2. Within the Programs, the User may be awarded "Bonuses" — notional incentive units which are provided to the User under the terms of the Programs and can be used only in accordance with this Offer and the Rules of the respective Program.


3. The terms of participation in the Programs, the procedure for awarding Bonuses, the grounds for their awarding/redemption, the Bonus validity period, the limits on the use of Bonuses (including the maximum number of Bonuses that can be used for one order), as well as other rules and restrictions are determined in the Rules of the respective Program, published by the Operator on the Platform and/or on the respective web pages for the respective country.


 4. Bonuses may be used by the User only as a discount (reduction of the amount payable) when placing an order on the Platform within the limits and under the conditions determined by the Rules of the respective Program and displayed on the Platform at the time of placing the order.


5. The terms of awarding and use of Bonuses may vary depending on the country in which the User uses the Platform. Information on the ratio of Bonuses to discounts on orders is shown to the User directly on the Platform interface or on the corresponding landing page and is for informational purposes.


6. Bonuses are not monetary funds, electronic money, or means of payment, are not subject to exchange for monetary funds, return, assignment (transfer) to third parties and may not be used otherwise than expressly provided for in this Offer and the Rules of the respective Program.


7. The Operator has the right to change the terms of the Programs and/or terminate them at any time, as well as set/change the limits and restrictions on the awarding and use of Bonuses, by updating the Rules of the respective Program and/or displaying the current terms on the Platform.


8 In case of detection of abuse, suspicious activity, violation of the terms of this Offer or the Program Rules, the Operator has the right to limit the User's participation in the Programs, cancel the awarded Bonuses and/or refuse to apply them.


9. The rules of the referral program are an integral part of this Public Offer.


§7 Complaint procedure

1. Complaints about the operation of the website or application may be sent by the user to the e-mail address: sushiicons.pl@gmail.com or in writing to the correspondence address of Chrystian Piotr Aigner 6/U5, 00-710, Warsaw, signed: for Sushi Icons. The complaint must contain at least the user's email address and a detailed description of the factual circumstances.


2. Complaints will be considered immediately, but not later than within 14 business days. The user will be notified of their complaint by email or letter.


§8 Client's right to terminate the agreement

Before the Restaurant fulfills the obligation, the Customer may terminate the contract without providing a reason, and this right may be exercised before the Restaurant has started processing the order.

In order to exercise the right to terminate the agreement, the Customer undertakes to inform the Restaurant with a clear statement via telephone communication with the Restaurant no later than 5 minutes after the confirmation that the order was taken to be fulfilled. After this moment, the order cannot be canceled or changed unless the Restaurant agrees. Informing the Restaurant of the desire to terminate the agreement by e-mail is not sufficient for a valid termination of the agreement.

If the Customer has made a payment online, the Restaurant will refund the costs within 14 business days and 72 hours after receiving the Restaurant's refund order.


§9 Final Provisions

1. In matters not covered by this Regulation, the provisions of the law of 2 March 2000 on the protection of certain consumer rights and on liability for damage caused by a dangerous product (Dz.U.2000nr22poz.271zezm.), the law of 27 July 2002 On special conditions for the sale of consumer goods and on amendments to the Civil Code (Dz.U. 2002 nr 141 poz. 1176 ze zm.), the law of April 23, 1964 Civil Code (Dz.U.1964nr16poz.93zezm.).

2. Disputes arising from the application of these Rules and referring the implementation of agreements concluded between the Store and Customers will be considered by the competent Court according to the regulations on property jurisdiction and local jurisdiction in accordance with the law of 17.11.1964 of the Civil Procedure Code (Dz.U.nr43poz.296ze.zm.).
